Vested Rights Petition

According to the City of Austin Ordinance No. 20140612-084, vested rights are defined as, "a right conferred by state law to develop property under ordinances, regulations, or rules other than those in effect on the date a permit application is submitted." In other words, vested rights can be claimed to initiate, continue, or complete a project that had previously been applied for through the City of Austin.

Upon approval of a Vested Rights Determination, the engineer is granted the right to design under the same development guidelines that were in place on the date of approval. However, this is only if the proposed work is consistent with the original project and not an unrelated development proposal.
